Terms and Conditions

Costa Insider, SL reserves the right to amend and update these Terms and Conditions, by posting notice of changed terms on the Orihuela Costa Buy and Sell Website.

All work is carried out in accordance with the undernoted Standard Terms of Business which supersede all previous agreements. If you have any questions regarding our terms, please contact us.

Marketing Advice Members shall also be known as the “Client”.

1. Commencement and Termination.

This Agreement shall come into force upon registering and shall remain in effect from the date you register, until terminated.

The Client is entitled to terminate this Agreement at any time by providing Costa Insider SL with formal notice in writing.

Costa Insider is entitled to terminate this Agreement and/or suspend the Client from a Costa Insider service, at any time. Reasonable notice of suspension/termination will be given where possible. An immediate suspension/termination facility is required for a number of reasons – these include (but not exclusively) any – malpractice, late payments or failure to comply with these agreed Standard Terms of Business.

The Client shall acquire no rights, following the termination of this Agreement, to use any Intellectual Property Rights of Costa Insider. This will include domain names, any text, images, banners or any other works created by or on behalf of Costa Insider.

2. Payment.

It is a requirement to pay in full for a minimum period of 1 month. Your signing up to a recurring monthly payment with your bank card, you can cancel this at any time by contacting us, we will cancel your future payments and you can continue to get the marketing advice newsletter and post your promotional messages until this period runs out.

Payment by bank transfer is no longer an option.

A free account option exists for businesses that do not wish to get the marketing advice newsletter and only need one free promotional post per month; you must register to use this option.

Local Charites get assigned six free additional promotional posts per month, but you must register for this.

3. Membership Details & Changes.

It is the responsibility of the Client to ensure all promotional details are correct and legal.

4. Group Rules

These rules will be changed from time to time and notice of the change will be displayed on the Group Admin page at https://www.facebook.com/orihuelacostabuyandsell/

5. No Payment for Facebook Group Posts

You are not paying for Facebook Group posts, these are always free, however, we reserve the right to allow business clients of Costa Insider to post more often for free depending on the level of Marketing Advice Membership they have, this is an additional free benefit for hiring our services. Facebook is a Trademark of Facebook, Inc and this website is not associated with them.

6. Sub-Licences.

The Client will grant, to Costa Insider, a revocable, non-transferable, royalty-free, international sublicense to display and link to their Web site or Web site content, and all trademarks, service marks, trade names, and/or copyrighted material (“Content”), from each of their Web Sites and/or subscription e-mail, for the limited purposes of promoting their program and subject to the terms and conditions of this Agreement.

7. Indemnification.

The Client shall keep Costa Insider indemnified against any claims for damages or other claims for compensation arising from the contents of the Client’s promotions or any incorrect information given to Costa Insider by the Client. The Client shall also compensate Costa Insider for any other damages or costs caused by the Client’s improper, negligent or unauthorised use of Costa Insider service and technical problems or loss of data caused by the Client on Costa Insider website or on any website to which the Client is linked by Costa Insider.

8. Liability – System failure, viruses, damages, downtime.

Costa Insider shall not be liable to the Client for defects in the service, interruptions in the accessibility to the service, infringements on data or loss of data on the information handling system, defects in the security system or viruses or other harmful software components, loss of profits, contracts, loss of reputation, loss caused by any third party deleting, removing, deactivating or tampering with the Affiliate Tracking Service or other indirect or consequential loss whether arising from negligence, breach of contract or whatsoever.

Costa Insider cannot guarantee or warrant the performance of Costa Insider service or the links to any linked websites. Costa Insider shall not be liable for any error in the implementation of the links for the Client’s website or for the specified function of the links.

9. Liability Limits.

Costa Insider total liability to the Client including in contract and tort (including the tort of negligence) shall not exceed 4x times your average monthly payment.

10. Legal Content and Approval.

The Client is solely responsible for his/her products/services/promotions and all its contents and shall ensure that they conform always to all applicable laws and regulations. If the Client is based outside of Spain then they must also undertake to ensure their service is compliant with the laws of Spain.

11. Copyright / Intellectual Property.

Costa Insider owns all copyrights, trademarks, intellectual property rights, know-how or any other rights connected to the service or software necessary for the service. This includes all programming, creative, artwork and images supplied by Costa Insider or on behalf of Costa Insider. The Client does not acquire any rights or licences whatsoever under this Agreement. Any creative or content designed or supplied by Costa Insider can only be used on Costa Insider Websites and Groups they control unless you have paid an additional external usage fee. Any Client using creative or content designed or supplied by Costa Insider, on another Group or Website, will automatically be charged a usage fee of €30.

12. Client’s Information e.g. emails, performance statistics.

The Client consents to the publication of the Client’s name and web address etc. on the Costa Insider website and to Costa Insider sending newsletters etc. The Client confirms that to enable Costa Insider to improve, promote or market the service, Costa Insider may produce statistics or summaries relating to the use of the service.

Costa Insider may contact the Client by email, telephone or post for feedback relating to the service, including any ways in which it might be improved, both for the Orihuela Costa Buy and Sell Facebook Group and for the individual Client.

13. Applicable Law.

Costa Insider shall not be liable for the legality of Costa Insider service in countries other than Spain. The Client is solely responsible for the legality of the use of the service if the Client is registered to the Costa Insider service from a country other than Spain.

This Agreement is subject to the laws of Spain and shall be subject to the non-exclusive jurisdiction of the Spanish courts.

If any dispute arises out of this Agreement the Parties will attempt to settle it by a mediation procedure as the parties may agree in writing.
